Bill Graham Estate Lawsuit Reinstated

SAN FRANCISCO (CelebrityAccess MediaWire) — A ruling by the Ninth U.S. Circuit Court of Appeals has revived a lawsuit brought by the sons of late west coast promoter Bill Graham, where they allege that their father's estate executor cheated them out of millions of dollars worth of music memorabilia.

The suit, brought by David Graham and Alexander Graham-Sult, alleges that estate executor Nicholas Clainos did not inform the sons that the sale of some of Graham's property included the music memorabilia, which included original concert posters for artists such as Bob Dylan and the Rolling Stones.

The suit was dismissed in 2011 when a federal judge determined that the alleged fraud was actually a legitimate business transaction that Clainos had disclosed to Graham's sons lawyers.

However, according to the San Francisco Chronicle, the Ninth U.S. Circuit Court of Appeals allowed the suit to be reinstated, noting that the case involved factual disputes and should be allowed to proceed towards a possible trial.

An attorney for Graham's sons told the San Francisco Chronicle: "We are looking forward to the chance to show that the Graham brothers are the rightful owners of these assets."
