(CelebrityAccess) – Gwen Stefani and Live Nation are arguing that they should not be held liable for injuries sustained by a woman at a 2016 show at PNC Music Pavilion in North Carolina.

Lisa Stricklin, whose leg was hurt after Stefani called on audience members to come forward and fill empty seats during the concert, is seeking more than $5 million in damages.

Stefani, who is seeking a summary judgment in her favor, is arguing that her call for fans to move forward is protected under free speech rights in America’s First Amendment. She is also arguing that she should not be ordered to pay any damages on account of the fact that she did not know her instruction would place any concertgoers in danger.

Live Nation, who operated the venue, is arguing that they should not be held responsible given that they had no way of knowing that Stefani would make such a request of the crowd.

According to Stricklin’s legal claim, she was sitting in reserved seating at the time the incident occurred and was subsequently trampled when fans began to push through barricades to approach the stage.
