Judge Rules StubHub Class-Action Suit Can Proceed

(CelebrityAccess) A California court has allowed a class action lawsuit against StubHub, regarding substantial fees tacked on to the final ticket price, to continue.

It is common for ticketing companies – to the consternation of patrons – to up the final price of a ducat at checkout time. However, the litigation in California, led by plaintiff Susan Wang, claims this practice violates state law, according to Complete Music Update. The lawsuit cites a recent case involving Bananas Republic in which it was alleged the retailer broke unfair competition and false advertising laws through their use of signage promoting a sale at the store. In that case, customers were allegedly told at checkout that the sale did not apply to all items, but they were compelled to buy the items after standing in the queue.

StubHub argued that the two cases were different but a judge on Monday ruled that the legal framework p;provided by the Banana Republic case was sufficiently similar although even though Wang’s case has crossed the first hurdle, “it may not get her past any other hurdle,” according to CMU.

He added that it should be easy for StubHub to list its full price up front, according to Law 360.
