ORLANDO, FL (CelebrityAcces) – According to HollywoodReporter.com, the family of Christina Grimmie, the 22-year-old singer who was fatally shot following a 2016 concert in Orlando, Florida, will be allowed to move forward with their lawsuit against AEG Live and the Orlando Philharmonic Orchestra who owned the venue where she died.
Grimmie, who had finished in third-place on the sixth season of NBC’s The Voice, was a rising star who had already toured with the likes of Selena Gomez and secured both television movie roles at the time of her death.
On June 10, 2016, at a meet and greet with fans, a man by the name of Kevin Loibl, who was known to have been infatuated with Grimmie, approached the young singer with both guns and a knife in hand and shot her three times. Loibl then took his own life.
Though Florida Circuit Judge Kevin Weiss had originally dismissed the Grimmie family’s legal claims last June, upon amendment, he has permitted them to assert claims of negligence against AEG and the Orlando Philharmonic Orchestra in addition to claims of breach of duty and breach of contract against AEG.
In their lawsuit, the Grimmie family has alleged that the defendants AEG Live “failed to take adequate security measures to ensure the safety of the performers and the attendees at the concert venue.”
The concert promoter moved for dismissal on the negligence claim making the argument that Grimmie’s family failed to inform them of the nature of a “special relationship that would give rise to it having any duty towards the singer.”
Grimmie’s family is also being allowed to move forward on claims of negligent infliction of emotional distress, and while they will not be able to recover damages for the singer’s lost income, there is a chance that the family could recover damages for the lost financial support they received from Grimmie due to her death.
