NEW YORK (CelebrityAccess) — Singer and recording artist Madonna is facing a federal lawsuit over the late start to the opening date of her North American segment of her ‘Celebrations’ tour in December.

In a complaint filed this week in a Federal Court, plaintiffs Michael Fellows and Jonathan Hadden allege that Madonna breached a contract with fans and was guilty of false advertising when she started multiple shows hours after the curtain was scheduled to go up.

“The concerts at the Barclays Center were advertised to start at 8:30 p.m., but Madonna did not take the stage until after 10:30 p.m. on all three nights, with most concert attendees leaving the Barclays Center after 1:00 a.m.” attorneys for the plaintiffs wrote in the lawsuit’s complaint.

“Defendants’ actions constitute not just a breach of their contracts with Plaintiffs and the Class Members, but also a wanton exercise in false advertising, negligent misrepresentation, and unfair and deceptive trade practices. As set forth infra, these acts or omissions are not countenanced by law, and Plaintiffs and the Class Members should be compensated for their damages,” the complaint continues.

The suit takes Madonna and her team to task both for failing to adequately notify fans of the late starts and for failing to provide them with refunds and notes that the singer has a long history of posting late for shows.

Defendants named in the suit include Madonna Louise Ciccone (AKA Madonna), Live Nation, MT Tours, and The Barclays Center as defendants.

Reps for Live Nation and Madonna did not immediately respond to requests for comment.
