Korn's Former Drummer Countersues Band, Claiming Loss Of Royalties

BAKERSFIELD (CelebrityAccess) David Silveria, the original drummer for Korn, has responded to a lawsuit the band has filed against him, countersuing the group, claiming it has kept him in the dark about royalties and is owed nearly $1 million.

Silveria, who left the band in 2006, claims he entered into a settlement agreement with the band in 2016, according to court documents obtained by The Blast. Silveria claims their agreement  “omitted any reference to the 2003 agreement between the partnership and Sound Exchange. The Settlement Agreement was also silent on the issue of how Sound Exchange royalties were to be apportioned.”

Korn sued Silveria last month, claiming he put a hold on the band’s royalty payments from SoundExchange despite having signed away his rights in the settlement. The drummer claims that he was unaware that the band had entered into an agreement with SoundExchange in 2003 to receive money and that the deal was concealed and payments were withheld from him.

He is suing for breach of contract plus other damages in excess of $750,000.
